Terms of Service

These Terms of Service ("Terms") govern your access to and use of jeekota.com and all associated services (the "Service") operated by Jeekota ("we," "our," or "us"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Eligibility

  • You must be at least 18 years of age to create an account and use the Service.
  • By using the Service, you represent and warrant that you meet this age requirement.
  • If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration and Security

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • One account per person. Creating multiple accounts may result in termination of all accounts.
  • We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

3. Description of Service

Jeekota is a community crowdfunding and discussion platform that enables users to:

  • Create and participate in community discussions on topics across 26 categories.
  • Launch validation campaigns to gauge community interest without financial commitment.
  • Create donation campaigns to raise funds for causes, projects, or initiatives.
  • Contribute to donation campaigns via secure payment processing.
  • Connect with and follow other community members.

4. User Content

4.1 Ownership

You retain ownership of the content you post on the Service. By posting content, you grant Jeekota a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and improving the Service.

4.2 Responsibility

You are solely responsible for the content you post. You represent that you have all necessary rights to post your content and that it does not violate any third-party rights.

4.3 Content Removal

We reserve the right to remove any content that violates these Terms or our Community Guidelines, without prior notice.

5. Trust Score System

  • All users receive an initial Trust Score of 100 upon registration.
  • Trust Scores decrease by 2 points for each unfulfilled funding commitment.
  • Trust Scores are publicly visible and affect your credibility on the platform.
  • Verified users (blue, grey, or orange tick) have undergone additional identity verification by our team.
  • Trust Score calculations are determined solely by Jeekota and are not subject to appeal.

6. Validation Campaigns

  • Validation campaigns allow users to gauge community interest without financial commitment.
  • Pledges in validation campaigns are non-binding expressions of interest only.
  • Campaign creators may convert successful validation campaigns to active donation campaigns.
  • Users who pledge in validation campaigns are expected (but not obligated) to contribute when campaigns go live. Failure to do so may affect Trust Scores.

7. Donations and Payments

  • All financial transactions are processed through Paystack, a PCI-DSS compliant payment processor.
  • Jeekota may charge a platform fee on donations (disclosed at the time of transaction).
  • Donations are generally non-refundable unless the campaign is found to be fraudulent.
  • Campaign creators are responsible for using donated funds as described in their campaign.
  • Jeekota does not guarantee the success or outcome of any campaign.
  • Withdrawal of funds by campaign creators is subject to verification and processing timelines.

8. Prohibited Conduct

You agree not to:

  • Post content that is illegal, fraudulent, defamatory, threatening, or obscene.
  • Infringe on any third party's intellectual property rights.
  • Use the Service for money laundering, terrorist financing, or any illegal purpose.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Distribute malware, viruses, or any harmful code.
  • Create false or misleading campaign information.
  • Manipulate Trust Scores, likes, or engagement metrics through fake accounts.
  • Harass, bully, or threaten other users.
  • Use automated tools (bots, scrapers) to access the Service without permission.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Jeekota and is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

10. Account Termination

  • We may suspend or terminate your account at any time for violations of these Terms, with or without notice.
  • You may delete your account at any time through your account settings.
  • Upon termination, your right to use the Service ceases immediately.
  • Sections that by their nature should survive termination (including indemnification, limitation of liability, and dispute resolution) shall survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE OR GUARANTEE ANY CAMPAIGN, USER, OR CONTENT ON THE PLATFORM.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JEEKOTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Jeekota, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached within 30 days, disputes may be submitted to binding arbitration.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 14 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.
